1. About Windfall

Windfall Pty Ltd (“Windfall”, “we”, “us”) provides a technology platform that helps Australians locate and claim unclaimed money from government registers, including ASIC, the ATO, and State Revenue Offices. By using our service, you agree to these terms.

2. Free search, success-based fee

Searching for unclaimed money is free. You are not charged to create an account, run searches, or view your potential matches.

If you choose to claim unclaimed money through our platform, we charge a success fee of 10% of the amount recovered. This fee is only payable after the money has been successfully released to you by the relevant government agency.

No win, no fee: If your claim is unsuccessful, or if the government agency rejects the claim, you owe us nothing.

3. How the fee works

  • The 10% success fee is calculated on the gross amount received
  • The fee is collected via Stripe after you confirm receipt of funds
  • For R&D Tax Incentive services, a separate fee of 8% applies
  • All fees are inclusive of GST

4. Your obligations

By using Windfall, you agree to:

  • Provide accurate information: You must provide truthful and accurate personal details. You must only search for money that may belong to you or someone you are legally authorised to act on behalf of.
  • Not misuse the service: You must not use Windfall to search for other people's unclaimed money without their consent, or attempt to fraudulently claim money that does not belong to you.
  • Pay success fees promptly: Once you receive unclaimed money that was claimed through our platform, you agree to pay the applicable success fee within 14 days of receiving the funds.
  • Cooperate with the claims process: You may need to provide identification documents, statutory declarations, or other information required by government agencies. You agree to provide these in a timely manner.

5. What we do for you

When you use our claiming service, Windfall will:

  • Search all applicable government unclaimed money registers
  • Identify potential matches based on the information you provide
  • Generate claim forms and supporting documents
  • Lodge claims with the relevant government agencies on your behalf
  • Track claim progress and notify you of updates

6. Limitations

  • Windfall is not a financial adviser, legal adviser, or tax agent. We provide a technology platform to help you locate and claim unclaimed money.
  • We do not guarantee that any search will find unclaimed money, or that any claim will be successful. Government agencies make the final decision on all claims.
  • Match confidence scores are estimates based on the information provided and should not be relied upon as guarantees.
  • Processing times depend on the relevant government agency and are outside our control.

7. Cancellation and account deletion

You may cancel your account at any time through the Settings page. Upon cancellation:

  • Any pending claims will continue to be processed unless you specifically request withdrawal
  • Success fees remain payable for any claims that have already been approved or paid
  • Your personal data will be deleted within 30 days, subject to legal retention requirements

8. Governing law

These terms are governed by the laws of the State of New South Wales, Australia. Any disputes will be resolved in the courts of New South Wales.
